Terms of Business of Dishidrop

Introduction

Welcome to our website. Please read these terms of business carefully, to avoid all misunderstandings. These terms relate to Dishidrop subscriptions supplied to you through our website and should be read in conjunction with the our Privacy Policy which shall also apply.You will be asked to expressly agree to these terms of business before you subscribe to Dishidrop from our website.

Our full name is Dishi Vegan Asian Kitchen, but we trade as Dishidrop on this website. We operate as a sole trader and registered at 238 Shalesmoor Road, Sheffield S3 8UH.Our email address is info@dishidrop.com 

Order process

For the steps you need to take in order to sign up to Dishidrop, please see our FAQs page. The minimum order is the Monthly Dishidrop plan. You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to buy a Dishidrop delivery.Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.After you sign up and create your account, you will receive an email from us confirming your order (“Confirmation”).  The Contract between us will only be formed when we send you the Confirmation. 

If you suffer from any food allergies, it is your responsibility to report these when you book your subscription, you will be asked. We list certain allergens which we cannot omit from anyone’s order. To recap, these are: tree nuts, peanuts, sesame, vinegar, mushrooms and soy. If you neglect to inform us of an allergen to which you suffer after you’ve received your meals, a refund will not be applied.

Your Dishidrop meal will be delivered in a re-usable tiffin box that will be collected with your next Dishidrop delivery. Please ensure that it is washed and clean before collection. Storage, cooking and re-heating instructions must be followed closely. Make sure that re-heated food is piping hot throughout. 

Price and payment

Prices for our Dishidrop plans are quoted on our website. In addition to the price of the Dishidrop, you have to pay for the tiffin box that your meal is delivered in - this tiffin box is yours to keep should you decide to end your deliveries.

Payment must be made upon submission of your order and will be collected automatically at the bi-weekly or monthly intervals stated on your Confirmation.  We may withhold Dishidrop deliveries and/or cancel the contract between us if the monies are not received from you in full in cleared funds. The prices on the website include all value added taxes (where applicable). 

Your Dishidrop service will continue automatically and payment will be collected until you notify us that you wish to cancel in accordance with clause 7 below. Prices for Dishidrop are liable to change at any time, but changes will not affect orders that have already been placed and we will give you advance warning if our prices are likely to change.

Delivery policy

We deliver only to the postcodes listed on our website. All orders are delivered between the times we specify at checkout. This is 2-5pm for everyone apart from those in the S36 postcodes, where it will be 5pm-7pm. Please let us know if you're not going to be in and we can leave it in your preferred spot. 

Please be aware that by signing up, you agree for your phone number to be passed on to delivery personal. Neither they nor Dishidrop will use your personal information for anything other than the intended purpose which is to ensure your Dishidrop gets to you in time for dinner. If you have entered alternative delivery instructions (for example “leave with a neighbour” or “leave in shed”) then this is entirely at your own risk and you will be responsible if the Dishidrop goes missing. It is agreed that anyone at the delivery address is entitled to accept delivery. 

If you miss the delivery and do not leave alternative delivery instructions or message us before your allotted delivery slot, we will not leave the Dishidrop and instead take it back to our kitchen. You will still be charged in this event.

You may reschedule delivery of your Dishidrop by up to 30 days (by logging into your account or emailing us at info@dishidrop.com) provided you give us 4 working days prior notice.The time that your order is delivered on Dishidrop day will vary week on week depending on traffic, weather and the number of deliveries to be made that day. If ordering regularly, you may notice that your delivery occurs at a similar time each week, however, we make no guarantee of this time and accept no liability for inconvenience or loss as a result of a deviation from it.

If you are going to be away on holiday and wish to pause the delivery, please email us or log into your account and your subscription will be paused until your return.

Changing your mind and cancellations

 Changing your mind: You may cancel your contract with us at any time by 6pm on the Monday prior to your delivery date by writing to us at: info@dishidrop.com. We will not take any further payments from you. Due to the perishable nature of the Dishidrop meals, you do not have a right to change your mind after delivery of the Dishidrop meals under the Consumer Contracts Regulations.

In the unlikely event that you are not satisfied with the quality of the meal or have any other complaint, please do contact us right away. Any refunds will be entirely at our discretion.

Statutory rights

Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

Refunds and exchanges

Refunds: If you cancel your contract and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day we received your valid notice of cancellation.

Limitations and exclusions of liability

Nothing in the terms of sale will: (a) limit or exclude the liability of a party for death or personal injury resulting from negligence; (b) limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party; (c) limit or exclude any liability of a party under Section 12, 13, 14 or 15 of the Sale of Goods Act 1979 or Part I of the Consumer Protection Act 1987; (d) limit or exclude any liability of a party in any way that is not permitted under applicable law.We will not be liable to you in respect of any losses arising out of any event or series of events beyond our reasonable control.

We will not be liable to you in respect of any business losses, such as loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

Other important terms

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms of use.

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. If you are a consumer, please note that these terms are governed by English law. This means a Contract for the purchase of Dishidrop through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

Communications between us

When we refer to "in writing" in these terms, this will include e-mail.If you wish to contact us in writing for any reason, you can write to us by e-mail or by pre-paid post to: Dishidrop 238 Shalesmoor Road, Sheffield S3 8UH.

If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.

Any change to your details must be notified to us promptly, either by updating your details via your account on the website or by emailing info@dishidrop.com.
